Crash Management Services Limited NZBN 9429031868945 (us, we, our, Crash Management) is committed to providing quality services to you and this privacy policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the IPPs contained in the Privacy Act. The IPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

A copy of the IPPs may be obtained from the website of the Office of the Privacy Commissioner at www.privacy.org.nz.

By accessing our Platform or the Portals or engaging with Crash Management, you consent to the collection, use and disclosure of your Personal Information in accordance with this privacy policy. The Platform and the Portals are owned, controlled, managed and maintained by our parent company, DingGo AU Pty Ltd (ABN 33 630 000 823) (DingGo), on behalf of Crash Management.

1. Definitions

Driver means the driver of a vehicle other than a Fleet Driver.

Fleet Admin User means any individual authorised by a Fleet Customer to access and use the Fleet Customer Portal.

Fleet Claims Portal means the web portal that enables Fleet Drivers to lodge a notification following an incident involving a vehicle that is designated as part of the Fleet Customer's fleet of vehicles.

Fleet Customer means a fleet customer receiving accident management services from Crash Management.

Fleet Customer Portal means the web portal accessible via the website available at https://www.dinggo.co.nz/ that enables Fleet Admin Users to access and use certain information and perform other authorised actions in relation to accident management services being provided by us to a Fleet Customer.

Fleet Driver means the designated driver of a vehicle that is designated as part of a Fleet Customer's fleet of vehicles.

IPPs means the Information Privacy Principles.

Personal Information means information that identifies an individual.

Platform means the website available at https://www.dinggo.co.nz/, the associated mobile website and mobile application (app), any associated or inter-Platform communications (e.g. emails, internal messages etc.) and any software relating to the foregoing, and any hypertext links linking to external sites (if any), from which the Services are provided by Crash Management.

Portals means the Fleet Claims Portal and the Fleet Customer Portal.

Privacy Act means the Privacy Act 2020.

Repair Services means the products and/or services (e.g. panel beating, windscreen repair, part replacement, wheel repair, paint work etc.) offered by Suppliers on the Platform.

Services means the services provided by Crash Management, specifically providing an online marketplace for the purpose of facilitating introductions and interactions between Users and Suppliers for various products and services (including Repair Services) that are from time to time made available by Suppliers and Crash Management on the Platform, and which can be booked by Users in accordance with the Terms and Conditions.

Supplier means any provider of Repair Services, vehicle damage assessment services, insurances or other related products or services that are from time to time available on the Platform.

Supplier User means any individual authorised by a Supplier to access and use the Platform.

Terms and Conditions means our terms and conditions available at https://www.dinggo.co.nz/termsandconditions.

2. What Personal Information do we collect, why do we collect it and how do we collect it?

If you are a Driver

If you are a Driver, the Personal Information we collect from you includes your name, address, email address, phone number, user name, password, information about your interactions with us, information about your computer or network, car registration and credit card information.

We collect your Personal Information for the purpose of conducting our business as contemplated in our Terms and Conditions, providing the Services to you, improving those Services, providing information to our Suppliers, and promotional and marketing activities. We may also collect Personal Information for the purpose of disclosing it to third parties who provide services directly to us, including third parties that provide our payment gateway, marketing, logistics and technology support services.

If you are a Fleet Driver

If you are a Fleet Driver, the Personal Information we collect from you includes your name, email address, phone number, date of birth and driver's licence number.

We collect your Personal Information for the purpose of enabling you to lodge a notification on the Fleet Claims Portal in respect of, and managing repairs to, a vehicle that is designated as part of a Fleet Customer's fleet of vehicles, and providing information relating to those repairs to that Fleet Customer. We may also collect your Personal Information for the purpose of disclosing it to third parties who provide services directly to us in connection with the provision by us of accident management services to a Fleet Customer, including third parties that provide towing services, smash repairs, hire cars and damage assessment services. We may also collect your Personal Information for the purpose of disclosing it to third parties who provide services directly to a Fleet Customer, including insurers.

If you are a Fleet Admin User

If you are a Fleet Admin User, the Personal Information we collect from you includes your name, email address, phone number, user name and password.

We collect your Personal Information for the purpose of enabling you to access and use, and managing your access to and use of, the Fleet Customer Portal. We may also collect your Personal Information for the purpose of disclosing it to authorised Fleet Customer personnel.

If you are a Supplier User

If you are a Supplier User, the Personal Information we collect from you includes your name, email address, phone number, user name and password.

We collect your Personal Information for the purpose of enabling you to access and use, and managing your access to and use of, the Platform. We may also collect your Personal Information for the purpose of disclosing it to authorised Supplier personnel.

Obtaining your Personal Information

Your Personal Information is obtained in many ways including face to face, by telephone, by email, an electronic form, a registration or subscription process, via our website, from your website, from media and publications, from other publicly available sources, and from cookies. 'Cookies' are small text files that are placed on your computer by the websites that you visit. The information collected through cookies is used to track anonymous usage of our website, for authentication purposes and to tailor the Platform to user preferences. You may disable, manage, and delete cookies in your browser settings. If you reject cookies, you may still use our website, but your ability to use some features or areas of our Platform might be limited.

If you do not provide all or any part of the Personal Information we request, you may be unable to set up an account with us and/or we may be unable to provide (or continue to provide) services to you.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting it, who we will give it to and how we will use or disclose it. Alternatively, those matters will be obvious from the circumstances.

We also might collect Personal Information from third parties where you have agreed with them that your Personal Information might be shared. We don't guarantee website links or privacy policies of authorised third parties.

Our website uses Google Analytics, a service which transmits website traffic data to Google servers in the United States. Google Analytics does not identify individual users or associate your IP address with any other data held by Google. We use reports provided by Google Analytics to help us understand website traffic and webpage usage.

By using our website, you consent to the processing of data about you by Google in the manner described in Google's Privacy Policy and for the purposes set out above. You can opt out of Google Analytics if you disable or refuse the cookie, disable JavaScript or use the opt-out service provided by Google.

3. Use and Disclosure of Personal Information

We will generally use or disclose your Personal Information only for the primary purpose for which it was collected (as set out in clause 2 above). We may also use or disclose your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. We may otherwise use or disclose your Personal Information for secondary purposes if you have given us consent for the use or disclosure (for example, for the purpose of training, testing, validating or refining artificial intelligence, machine learning, or similar technologies that we use to provide the Services), or it is required or authorised by the Privacy Act or another law of New Zealand.

Before using your Personal Information for the purpose of training, testing, validating or refining artificial intelligence, machine learning, or similar technologies that we use to provide the Services, we will anonymise (i.e., deidentify) and aggregate it with similar information so that you cannot be identified directly or indirectly from any outputs from those technologies.

If Personal Information is anonymised (i.e., deidentified) and aggregated with similar information so that it is no longer reasonably associated with an identified or identifiable individual (i.e., it is no longer "Personal Information"), we may use it for any business purpose, including to improve the features and functionality of our Platform, training, testing, validating or refining artificial intelligence, machine learning, or similar technologies, and to build the body of data, that we use to provide the Services.

If those purposes for which we have collected the information involve disclosing your Personal Information to a third party, we will take appropriate and reasonable steps to ensure that Personal Information is protected.

In relation to marketing activities, you may unsubscribe or 'opt-out' from our mailing lists and direct marketing communications at any time. Additionally, our electronic marketing activities will comply with the requirements of the Unsolicited Electronic Messages Act 2007.

Your Personal Information may be disclosed to recipients in:

  • Australia. This is where DingGo and our head office are based. DingGo is subject to privacy laws that provide comparable safeguards to the Privacy Act, and
  • other countries where DingGo, on behalf of Crash Management, engages a third-party service provider to provide services to support the provision of the Services by Crash Management (e.g. to take and process calls from Drivers and Fleet Drivers). Crash Management has reasonable grounds to believe that in these circumstances your Personal Information will be protected by a privacy law with comparable privacy safeguards to the Privacy Act.

Except as outlined above your Personal Information will not be disclosed to recipients outside New Zealand unless you expressly request us to do so — noting however that personal information and data collected by Google Analytics may be stored overseas.

4. Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

5. Security and Retention of Personal Information

The security of your Personal Information is important to us. We will take such steps as are reasonable in the circumstances to protect your Personal Information from misuse, loss and any unauthorised access, use, modification or disclosure. We take appropriate industry recognised steps to protect your Personal Information, including use of technologies and processes such as access control procedures, network firewalls, encryption and physical security. However, please be aware that the internet is not a secure environment. If you send us any information over the internet (in whatever way or format), you send it at your own risk.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy, delete or permanently de-identify your Personal Information.

6. Access to your Personal Information

You may access the Personal Information we hold about you and you may update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us as set out in clause 9 below.

We will not charge a fee for your access request, but reserve the right to charge an administrative fee for searching for and providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

7. Maintaining the Quality of your Personal Information

It is important to us that your Personal Information is accurate, complete and up-to-date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, incomplete or out-of-date, please advise us as soon as practicable. If we consider that the correction is reasonable (and we are reasonably able to make the correction), we will update our records so that we can continue to provide quality services to you. If we do not make the correction, we will take reasonable steps to note on your Personal Information that you requested the correction.

8. Policy Updates

This privacy policy may change from time to time and is available on our website. If you have any objections to the privacy policy at present or at any time in the future, you should not access or use our Platform or the Portals.

  • wish to make a complaint about our handling of Personal Information we hold about you,

We request that all complaints be made in writing and sent to the email address listed below so that we can be sure about the details of the complaint. We will treat your complaint confidentially, investigate your complaint and aim to ensure that we contact you and your complaint is resolved within a reasonable time (usually 30 days).
